Religious beliefs are defined as thinking, feeling and behaving in accordance with the beliefs and teachings of a religious system. In other words, religious beliefs are indicative of the role of religion in the individual and social life of people, as well as adherence to values and beliefs in daily life, performing religious practices and rituals and participating in activities of religious organisations. Religious beliefs are a set of dos and don'ts, and values are considered one of the most important (...) psychological supports that can provide meaning in all moments of life and save a person from meaninglessness by providing explanatory support in specific situations. In addition, work conscience is defined as a feeling of inner commitment to comply with agreed-upon requirements for work. In other words, work conscience means heartfelt satisfaction and practical commitment to the tasks that a person is supposed to perform properly, in a way that there will be no negligence in performing the duty even if no supervisor oversees the activity. Given the significant role of nurses in hospitals, especially during the coronavirus disease 2019 (COVID-19) pandemic, the religious beliefs of healthcare employees have become more important. Therefore, the present study aimed to evaluate the effect of religious beliefs on the work conscience of 1800 Muslim nurses in Iraq during the COVID-19 pandemic in 2021. Standard questionnaires were applied to assess the respondents' religious beliefs and work conscience. In addition, data analyses (Cronbach's alpha, Pearson's correlation, etc.) were performed in Statistical Package for the Social Sciences (SPSS). According to the results, religious beliefs have a positive effect on nurses' work conscience (p = 0.822). CONTRIBUTION: The findings of this study showed that the employees of an organisation, especially nurses and healthcare staff, can rely on their religious beliefs and benefit from their advantages in order to strengthen their work conscience during a hard time such as the COVID-19 pandemic. AimHealthcare workers have directly provided care for COVID-19 patients, and have faced many additional sources leading to poor mental health. The study aimed to investigate the mental health problems and related factors among healthcare staff in Vietnam.MethodsA descriptive cross-sectional mixed methods study, combining quantitative and qualitative research methods, was performed among 400 healthcare workers working at the National Hospital for Tropical Diseases and Ninh Binh General Hospital from the first day of treatment for COVID-19 patients to May 01, 2020.ResultsThe results (...) showed that 8.0% of participants had stress, 17.5% of participants had anxiety, and 14.8% of participants had depression. Approximately 50% of participants reported that they had at least one of these symptoms. The findings illustrated that stress, anxiety, and depression were associated with the position in a hospital, health status during the COVID-19 pandemic, family members/relatives infected with COVID-19, physical and mental support from friends, family, and community, department, years of working, and the average work hours per day of healthcare workers exposed to COVID-19.ConclusionDuring the COVID-19 pandemic, healthcare workers who worked in the hospital providing treatment and care for COVID-19 patients dealt with mental health problems such as stress, anxiety, and depression. It is necessary to promote mental health among healthcare workers, to contribute to the fight against the COVID-19 outbreak in Vietnam. (shrink)

This article contributes to the limited literatures on small- and medium-size enterprises and corporate social responsibility. Using an institutional theoretical framework, we analyzed fieldwork interviews with twenty SMEs and perspectives of 165 SME managers and workers in textiles, garment, and footwear industries, the most important wage-earning sector in Vietnam. Having understood in the context of a developing “market economy with socialist orientation”, we find that socially responsible practices and expectations developed long before the arrival of CSR as a western concept (...) and an MNC agenda. While identifying and contributing ideas concerning forms of “informal” CSR practices—influenced by social and cultural expectations—to the CSR/sme literature, we are conscious of the mixed effects of these practices and the ongoing nuanced negotiations between workers and managers in these SMEs. In our research, we found that it takes both domestic and international stakeholders to improve labor conditions in Vietnam under the banner of CSR. (shrink)

Nowadays, the power systems are getting more and more complicated because of the delays introduced by the communication networks. The existence of the delays usually leads to the degradation and/or instability of power system performance. On account of this point, the traditional load frequency control approach for power system sketches a destabilizing impact and an unacceptable system performance. Therefore, this paper proposes a new LFC based on adaptive integral second-order sliding mode control approach for the large-scale power system with communication (...) delays. First, a new linear matrix inequality is derived to ensure the stability of whole power systems using Lyapunov stability theory. Second, an AISOSMC law is designed to ensure the finite time reachability of the system states. To the best of our knowledge, this is the first time the AISOSMC is designed for LFC of the LSPSwCD. In addition, the report of testing results presents that the suggested LFC based on AISOSMC can not only decrease effectively the frequency variation but also make successfully less in mount of power oscillation/fluctuation in tie-line exchange. Despite increasing scholarly interest in tertiary student perceptions of plagiarism, very little is known about those held by postgraduate students, although differences between undergraduate and PG students relate to both their characteristics and the demands of their studies. Furthermore, there is a dearth of research within the context of international education, where managing plagiarism is seen as a major challenge. This paper reports on a recent online survey with 207 Vietnamese and local PG students at a New Zealand university regarding (...) their perceptions of plagiarism. The findings showed significant differences both between and within the two groups. Perception variations arose from a range of influences and prior experiences, not just the culture in which the students were initially educated. Differences related to participants’ age, gender, academic levels, disciplines, and teaching experience. This study’s findings contribute knowledge about under-researched PG students and problematize prevalent stereotypes of international students regarding plagiarism. They generate implications for higher education institutions to accommodate international and domestic PG student needs in ways that respect their diversities in detail as individuals, not as members of a homogeneous group. Further qualitative research to explore PG student perceptions in greater depth is recommended. (shrink)

This paper applies a proposed modified stochastic fractal search algorithm (MSFS) for dealing with all constraints of optimal reactive power dispatch (ORPD) and finding optimal solutions for three different cases including power loss optimization, voltage deviation optimization, and L-index optimization. The proposed MSFS method is newly constructed in the paper by modifying three new solution update mechanisms on standard stochastic fractal search algorithm (SSFS). The first modification is to keep only one formula and abandon one formula in the diffusion process (...) while the second modification and the third modification are used in the first update and the second update. In two updates of SSFS, solutions with low quality are updated with high probability while other solutions with high quality do not get chances to be updated. This manner results in the fact that some promising solutions around the high quality solutions can be missed. In order to tackle this restriction, the second modification of MSFS is to newly update the worst solutions in the first update and the best solutions in the second update. In the third modification, all existing formulas of SSFS in the two updates are abandoned and the same new proposed technique is used for updating such solutions in two updates. Compared to SSFS, the three modifications can bring advantages to MSFS such as using smaller number of produced solutions per iteration, spending shorter execution time, finding better optimal solutions, and owning more stable search ability. Furthermore, the proposed method also sees its effectiveness and robustness over SSFS by testing on IEEE 30-bus system and IEEE 118-bus system with three different single objectives for each system. The proposed method can find less minimum, average, and maximum for all the cases in addition to faster search speed. Besides, the proposed method is also compared to other methods such as PSO-based method group, GA-based method group, DE-based method group, and other recent methods. Result comparisons also indicate that the proposed method can be more efficient than almost all these methods with respect to less minimum and smaller values of control parameters. As a result, evaluation of the performance of the proposed method is that it should be used for seeking solutions of ORPD problem. (shrink)

Objectives: The official implementation of clinical pharmacy in Vietnam has arrived relatively late, resulting in various stressors. This study aims to evaluate job stress level and suggest viable solutions.Methods: A cross-sectional study was conducted on clinical pharmacists in 128 hospitals in Ho Chi Minh City. Job stress questions were derived from the Healthcare Profession Stress Inventory.Results: A total of 197 CPs participated, giving a response rate of 82.4%. Participants were found to have moderate job stress with an overall mean stress (...) score of 1.5 and stress rate of 52.8%. The sample size was statistically adequate and the HPSI was valid and reliable. Patient care responsibility was the main stressor, especially in public hospitals, followed by job conflicts. Lack of experience, low income, and inability to participate in clinical ward rounds caused significant stress to CPs regarding job recognition and job uncertainty. More practice-oriented training programs in bachelor curricula and clinical practice should be applied to help CPs gain more experience, self-confidence, and diminish job stress.Conclusion: CPs in HCMC have moderate stress. More practice-oriented training programs should be prioritized to lessen stress for CPs. (shrink)

As a generation of ‘digital natives,’ secondary students who were born from 2002 to 2010 have various approaches to acquiring digital knowledge. Digital literacy and resilience are crucial for them to navigate the digital world as much as the real world; however, these remain under-researched subjects, especially in developing countries. In Vietnam, the education system has put considerable effort into teaching students these skills to promote quality education as part of the United Nations-defined Sustainable Development Goal 4 (SDG4). This (...) issue has proven especially salient amid the COVID−19 pandemic lockdowns, which had obliged most schools to switch to online forms of teaching. This study, which utilizes a dataset of 1061 Vietnamese students taken from the United Nations Educational, Scientific, and Cultural Organization (UNESCO)’s “Digital Kids Asia Pacific (DKAP)” project, employs Bayesian statistics to explore the relationship between the students’ background and their digital abilities. Results show that economic status and parents’ level of education are positively correlated with digital literacy. Students from urban schools have only a slightly higher level of digital literacy than their rural counterparts, suggesting that school location may not be a defining explanatory element in the variation of digital literacy and resilience among Vietnamese students. Students’ digital literacy and, especially resilience, also have associations with their gender. Moreover, as students are digitally literate, they are more likely to be digitally resilient. Following SDG4, i.e., Quality Education, it is advisable for schools, and especially parents, to seriously invest in creating a safe, educational environment to enhance digital literacy among students. We present our method for tackling a legal case retrieval task by introducing our method of encoding documents by summarizing them into continuous vector space via our phrase scoring framework utilizing deep neural networks. On the other hand, we explore the benefits from combining lexical features and latent features generated with neural networks. Our experiments show that lexical features and latent features generated with neural networks complement each other to improve the retrieval system performance. Furthermore, our experimental results suggest (...) the importance of case summarization in different aspects: using provided summaries and performing encoded summarization. Our approach achieved F1 of 65.6% and 57.6% on the experimental datasets of legal case retrieval tasks. (shrink)

This paper investigates the task of reference resolution in the legal domain. This is a new interesting task in Legal Engineering research. The goal is to create a system which can automatically detect references and then extracts their referents. Previous work limits itself to detect and resolve references at the document targets. In this paper, we go a step further in trying to resolve references to sub-document targets. Referents extracted are the smallest fragments of texts in documents, rather than the (...) entire documents that contain the referenced texts. Based on analyzing the characteristics of reference phenomena in legal texts, we propose a four-step framework to deal with the task: mention detection, contextual information extraction, antecedent candidate extraction, and antecedent determination. We also show how machine learning methods can be exploited in each step. The final system achieves 80.06 % in the F1 score for detecting references, 85.61 % accuracy for resolving them, and 67.02 % in the F1 score for the end-to-end setting task on the Japanese National Pension Law corpus. As a model for processing information about people's perceptions to understand the complex world and society in which they live, the cultural schema serves as a key concept in Cultural Linguistics when directing to the perception and processing of information about people, and social groups, and events. Cultural schema theory is valuable in deciphering culturally structured concepts, covering the entire range of human experience expressed in many fields such as education, belief, religion, etc. Through the practice of sacred rituals, each (...) religious believer can form his system of ideas about entities in his or her belief world. Those experiences and experiences are conceptualized through the language picture. In the process of cultural development and integration, the cultural awareness of the Catholic community also reflects certain changes in Catholicism in the West in harmony with the customs and beliefs of Eastern countries. like Vietnam, expressed through the practice of funeral rites and traditional marriage of the Vietnamese. In this article, by using quantitative and qualitative methods, we have conducted a character analysis of the above cultural schemas based on the corpus of 120 discourses drawn during the implementation perform funeral and marriage rites for Vietnamese Catholics. Research results show that cultural schemas (event diagrams, role schemas, image schemas, propositional schemas, and emotional schemas) reflect the cultural knowledge (beliefs, standards, principles, and expectations) of each Vietnamese Catholic about DEATH and MARRIAGE as a journey or a new transformation in one's life... That is the basis for them to transmit achieve and explain the basic values of these two concepts, helping us to understand more deeply the mind of the Vietnamese Catholic community in Vietnam when performing two important rituals in human life in reality. The so-called “conciliatory” norm in epistemology and meta-ethics requires that an agent, upon encountering peer disagreement with her judgment, lower her confidence about that judgment. But whether agents actually abide by this norm is unclear. Although confidence is excessively researched in the empirical sciences, possible effects of disagreement on confidence have been understudied. Here, we target this lacuna, reporting a study that measured confidence about moral beliefs before and after exposure to moral discourse about a controversial issue. Our findings indicate (...) that participants do not abide by the conciliatory norm. Neither do they conform to a rival “steadfast” norm that demands their confidence to remain the same. Instead, moral discourse seems to boost confidence. Interestingly, we also find a confidence boost for factual beliefs, and a correlation between the extremity of moral views and confidence. One possible explanation of our findings is that when engaging in moral discourse participants become more extreme in their opinions, which leads them to become more confident about them, or vice versa: they become more confident and in turn more extreme. Although our work provides initial evidence for the former mechanism, further research is needed for a better understanding of confidence and moral discourse. (shrink)

The accession and implementation of new generation free trade agreements bring numerous opportunities as well as challenges to Viet Nam, regarding trade, labor and investment. The increasing number of workers abroad puts a pressure on Vietnamese government to support them in new working cultures and environments. The application of chatbot, which has been known to help certain vulnerable groups such as patients, women and migrants could be one of the tools to support Vietnamese migrant workers by providing immediate information, (...) network connection and consultation. Analyzing the results of the qualitative interviews with 11 migrant workers and the group discussion with two sections from three public social media groups and three active informants, the article argues that migrant workers as a vulnerable group who are supposed to be promising users of chatbot due to their great demand and needs, may have a complicated form of trust and expectation in chatbot. The digital era brings various benefits to adolescents. However, operating on the digital environment without sufficient knowledge and skills will expose them to multiple types of risks, especially in the country with low digital safety education rate like Vietnam. The current study examines factors that can contribute to cultivating adolescents’ digital resilience using the information-processing reasoning of the Mindsponge Theory. A UNESCO dataset of 1061 Vietnamese high school students was analyzed using the Bayesian Mindsponge Framework analytics. It is found (...) that adolescents’ daily Internet usage frequency, parents’ Internet safety guidance, and teachers’ safety guidance are positively associated with digital resilience. However, the effects of parents’ and teachers’ Internet safety guidance on digital resilience are conditional on the daily Internet usage frequency. Parents’ guidance only enhances adolescents’ digital resilience if they use the Internet less than four hours per day. In contrast, the positive effect of teachers’ guidance on adolescents’ digital resilience becomes stronger when the students spend more time on the Internet (more than 1 hour). Based on these findings, we suggest that adolescents can learn to minimize risks and protect themselves by exposing more to the digital environment. Parents’ and teachers’ supports are important in enhancing adolescents’ capability to deal with digital threats, but types of supports need to be carefully considered to avoid reverse impacts on adolescents’ resilience. The doctor-patient relationship has evolved to respect “the autonomy and patients’ rights”. One of the cornerstones in such autonomy is the opportunity for patients to draw living wills, also known as advance directives. However, information about AD available to patients remains scarce largely due to the lack of involvement of General practitioners for several reasons. The aim of our study was to evaluate current general practitioner residents’ behavior concerning their role in informing their patients about AD. We built a French (...) nationwide survey from GPR class of 2012 to 2014. Two thousand three hundred ten residents completed our survey. 89.8% declared their willingness to offer patients the opportunity of writing AD. When asked about the usefulness of AD, 73.6% of residents responded that these are a suitable help for patients, but 19.7% considered that AD are essentially geared towards frail patients. Among residents who want to inform patients about AD, 14.7% wanted to involve all patients. Only 20.5% thought that elderly people should be systematically informed about AD. When the question involves other frail people in various disease areas, information seems relevant for 60.1% of GPR considering patient with cancer or malignant hematologic disease and for 56.2% about patients affected by neurodegenerative disease. When considering the routine use of AD, 20.5% of GPR would take them into account only if they are in agreement with the patient’s decision. The results of the survey indicate that GPR would rather choose to decide who should be informed about AD, and when to take AD into account for ethical concerns. (shrink)

Person‐specific evidence was developed as a grounded theory by analyzing 20 selected case descriptions from interventions using the guided self‐determination method with people with various long‐term health conditions. It explains the mechanisms of mobilizing relational capacity by including person‐specific evidence in shared decision‐making. Person‐specific self‐insight was the first step, achieved as individuals completed reflection sheets enabling them to clarify their personal values and identify actions or omissions related to self‐management challenges. This step paved the way for sharing these insights (...) and challenges in a relationship with a supportive health professional, who could then rely on person‐specific evidence instead of assumptions or a narrow disease perspective for shared decision‐making. Trust in the evidence encouraged the supportive health professional to transfer it to the interdisciplinary team. Person‐specific evidence then enhanced the ability of team members to apply general evidence in a meaningful way. The increased openness achieved by individuals through these steps enabled them to eventually share their new self‐insights in daily life with other people, decreasing loneliness they experienced in self‐management. Relational capacity, the core of the theory, is mobilized in both people with long‐term health conditions and healthcare professionals. Further research on person‐specific evidence and relational capacity in healthcare is recommended. (shrink)

Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often contain long articles and only some parts are relevant (...) to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task. This article questions whether the ‘problem’ of trans issues lies more in the binary, patriarchal structures of our society than it does in our bodies. I utilize Marcella Althaus-Reid’s ‘Hermeneutic of Mutilation’, arguing that, much as ‘to give hospitality to our own fragmentations may require sometimes acts of transformations’, we must not support the heteropatriarchal pattern and system as it attempts to normalize, police, control or punish the ‘deviant’ bodies of transgender individuals, from ‘wrong’ and ‘less than’ into ‘right’ and (...) ‘cured’. As postmodern deconstruction has informed and influenced our thinking around identity, the modern, biological approach to sex/gender has been profoundly challenged. I will make a parallel between current debates around trans issues and disability, body and liberation theology; if disability only ‘becomes’ a disability when the able-bodied majority designates it as ‘other’, are trans folk being similarly ‘othered’, as their different bodies, perspectives or identities challenge the fearful, defended mind-sets of society? Should we continue to prioritize ‘fixing’ trans bodies, in order to have them fit more neatly within that society? Or, should we challenge the patriarchal, heteronormative moulds of a culture that would rather trans individuals ‘accept’ their ‘wrongness’ and take steps to ‘correct’ that wrongness? This is not to say that trans+ individuals should not continue to make exactly the same medical/surgical choices as are currently the norm and even to choose modes of gender expression that are binary or ‘traditional’, should that be their desire and choice. Rather, this is an appeal for all of us to challenge a society that deems some bodies ‘right’ and others as ‘wrong’, and expects such painful conformity. (shrink)

Lewis also claims that there is no trans-world causation because there is no way to make sense of trans-world counterfactuals without automatically making them come out to be false. In this paper I argue against this claim. I show how to make sense of trans-world counterfactuals in a non-trivial (...) way that can make them come out to be true, by appealing to relations of comparative similarity among concrete possible worlds (i.e., assuming modal realism). I argue that either merely making such sense of a relevant counterfactual is not enough to have causation, or that Lewis’ modal realism must be given up. (shrink)

The dispute between the transgender-rights movement and “gender-critical” activists represents a stark division in British public discourse. Although the issues of contention are numerous and require their own philosophical treatment, a core metaphysical concern underlies them. Gender-critical activists, such as Kathleen Stock, tend to argue that recognizing trans women as women requires erasing the category of biological sex. This implies that all trans women are male, and thus recognizing them as women rips female biology from the root of (...) the category “woman.” In this article, I argue that this view is mistaken. As exogenously produced sex characteristics should count toward a person's sex classification, all trans women are female. (shrink)

This paper critically analyses three main neurobiological hypotheses on trans* identities: the neurobiological theory about the origin of gender dysphoria, the neurodevelopmental cortical hypothesis, and the alternative hypothesis of self-referential thinking and body perception. In this study I focus then the attention on three elements: the issue of (de)pathologisation, the idea of the trans brain, and the aetiology of trans* identities. While the neurobiological theory about the origin of gender dysphoria and the neurodevelopmental cortical hypothesis claim the existence of the (...) trans brain, each offering its own neurobiological depiction, the hypothesis of self-referential thinking and body perception doesn’t postulate a distinctive neurobiological trait for all trans* people. I problematize both portrayals of the trans brain departing from the findings and conceptualizations of the paradigm shifting brain mosaicism. Unlike the hypothesis of self-referential thinking and body perception that keeps the question of causation open, both the neurobiological theory about the origin of gender dysphoria and the neurodevelopmental cortical hypothesis situate the origin of trans* identities in the neurobiological domain. I challenge the biological deterministic framework in which this aetiology is inscribed from a dynamic processual entanglement perspective. Finally, concerning the issue of (de)pathologisation of trans* identities, an evolution can be seen in each of the hypothesis and among them, from the least to the most depathologising. However, I question their complete departure from a pathologising framework. (shrink)

Trans persons endure terrible injustices in this life: They are bullied, murdered, forced to conceal their identities, and denied opportunities that would be available to them if they were cis. This chapter offers grounds for theological hope—in particular, hope that the afterlife would be better for trans persons. I argue that we should view trans identities as worthy of respect and that, as a matter of justice, their gender identities should be preserved in the afterlife. I focus specifically on (...) trans persons with interests in transitioning and argue that they are owed an opportunity to transition in the afterlife. Moreover, the parties responsible for their earthly abuse are principally responsible for any transitioning costs and must participate directly in the process. Finally, trans persons should be provided opportunities to procreate and enter romantic unions they were denied during their earthly lives because of their trans identities. (shrink)

What is it to be a woman? What is it to be a man? We start by laying out desiderata for an analysis of 'woman' and 'man': descriptively, it should link these gender categories to sex biology without reducing them to sex biology, and politically, it should help us explain and combat traditional sexism while also allowing us to make sense of the activist view that gendering should be consensual. Using a Putnam-style 'Twin Earth' example, we argue that none (...) of the existing analyses in the feminist literature succeeds in meeting all of our desiderata. Finally, we propose a positive account that we believe can satisfy all the desiderata outlined. According to our theory, the genders 'woman' and 'man' are individuated not by their contemporary connections to sex biology, but by their historical continuity with classes that were originally closely connected to sex biology. In eukaryotic cells intron sequences are usually spliced out with a high degree of precision from heterogenous nuclear RNA (hnRNA) to give functional mRNA with exons in their right order. Provided with the right substrates, cell extracts can achieve the same. With exotic substrates, on the other hand, the same extracts can cut exons from one RNA and join them to exons from another RNA, a process termed trans‐splicing. In vivo, RNA trans‐splicing could lead to faulty, but also to (...) novel proteins and, through reverse transcription, to genomic rearrangements. So far, in living cells trans‐splicing has only been invoked to occur in trypanosomes. In these unicellular organisms most if not all mRNAs are made discontinuously, so that the mature mRNAs carry, at their 5′ end, a common 35‐nucleotide sequence, called a miniexon, encoded separately in the genome. The miniexon is most likely joined to the body of the mRNA by trans‐splicing. (shrink)

Existing understandings of gender affirm some types of gendered accounts as “authentic,” while others are discredited or obscured. As a consequence, many transgender people express anxiety about whether their experience of gender can be distilled into a narrative that is intelligible to others and appears consistent over time. In this article, I assess the identity narratives produced by two cohorts of trans respondents—binary-identified respondents, and non-binary respondents—as a means of understanding the narrative strategies that respondents employ to establish themselves as (...) “authentically” trans. To affirm themselves as trans, I find that non-binary participants tended to elide or to minimize potential inconsistencies in their stories, producing narratives that reflect dominant cultural accounts of trans experience—accounts that center an early-childhood affiliation with the “opposite” sex, endorsing and affirming binary gender distinctions. In turn, binary-identified participants often produced accounts that complicated or questioned these tropes. While non-binary individuals have been hailed as the primary arbiters of gender’s undoing, the social and institutional constraints that inform how we account for gender—which shape both our production of those accounts and others’ interpretations of them—suggest that binary-identified respondents may be better positioned to work towards this “undoing” than their non-binary counterparts. The relationship between art and time is one of pre-figuration–transfiguration, a continuous exchange between the art of the present and that of the past and it is in this sense that we can understand how the works of art are have almost their entire life before them. It is in this sense also that the real meaning of metamorphosis should be understood: The works of art are not permanent acquisitions. They offer themselves the ways through which they appear in (...) another light, gathering up at the same time a series of antecedent expressions in an eternity ever to be recreated. Hence, art’s time is neither a-historical nor exclusively history embedded (in history’s empirical sense). Art’s time is trans-historical: artworks, initiating themselves the process of their metamorphosis, ‘transcend’ time being into time and, thus, they ‘traverse’ history. (shrink)

This article develops a discursive explanation of mixed constitution: mixed constitutional ideas and discourse generate mixed constitutional design and practice. On that base, it explores the nature, factors, and functions of the mixed constitution in Vietnam. The emergence of competing constitutional ideas (Confucian, socialist, liberal, universal) animates a constitutional discourse in which different actors adhere to different ideas. Consequently, the 2013 Constitution of Vietnam embodies a mixture of the ideas in its provisions on political institutions, economy, and especially human rights. (...) The enforcement of the constitution induces competing claims to constitutional meanings. The mixed constitution is shaped by path dependency and global diffusion of constitutional ideas. This article offers a comprehensive review of Political Choreographies, Decolonial Theo-ries, Trans Bodies, the latest book, a volume edited by Marina Gržinić and Jovita Pristovšek in intensive collaboration with Nomusa Makhubu and Tjaša Kancler, published by Cambridge Scholars Publishing in 2023. This volume takes as its starting point the body as a structural signifier, which is conceptualized in seven chapters. Each of them addresses the question of movement, politics, revolt, action, etc., in a variety of ways to de-link ourselves (...) (especially us Whites) from colonial modernity as the organizing principle not only of capitalism but of a whole range of processes that emanate from modernity, i.e., forms of domination and oppression such as racism, sexism, Eurocentrism, and environmental destruction. What makes this book special, however, is not only the positions presented but also the way in which they are presented. Each conversation begins with a carefully selected starting point, linked to the interlocutor’s* work and accompanied by a rich citation system of references and additional information. This opens up the formation of epistemic counter-narratives that confront the violent history of capitalism and form possibilities for yet unidentified bodies, movements, politics, and political action as future potentialities. Cosmopolitanism is said by many critics to be arrogant. In emphasizing universal principles and granting no fundamental moral significance to national or other group belonging, it wrongly treats those making non-universalist claims as not authorized to speak, while treating those in non-Western societies as not qualified. This book works to address such objections. It does so in part by engaging the work of B.R. Ambedkar, architect of India's 1950 Constitution and revered champion of the country's Dalits (formerly "untouchables"). Ambedkar cited (...) universal principles of equality and rights in confronting domestic exclusions and the "arrogance" of caste. He sought to advance forms of political humility, or the affirmation of equal standing within political institutions and openness to input and challenge within them. This book examines how an "institutional global citizenship" approach to cosmopolitanism could similarly advance political humility, in supporting the development of input and challenge mechanisms beyond the state. It employs a grounded normative theory method, taking insights for the model from field research among Dalit activists pressing for domestic reforms through the UN human rights regime, and from their critics in the Hindu nationalist Bharatiya Janata Party. Insights also are taken from Turkish protesters challenging a rising domestic authoritarianism, and from UK Independence Party members demanding "Brexit" from the European Union-in part because of possibilities that predominantly Muslim Turkey will join. Overall, it is shown, an appropriately configured institutional cosmopolitanism should orient fundamentally to political humility rather than arrogance, while holding significant potential for advancing global rights protections and more equitable rights specifications. Tom Reucher uses excerpts from the writings of various psychology specialists who operate as experts with respect to transsexuality. A close reading shows that these texts produce discrediting, insulting, sexist, homophobic and transphobic discourses. These writings show the fear of the so-called « experts », whose attachment to obsolete theories leaves them ignorant of the questions around transsexuality. Transsexuals and transgenders who speak up against the professionals and experts speaking in their place is something new in France. It goes (...) along with the reappropriation of their identity by self-naming and the creation of organizations to defend their rights. Medical and surgical practices can lead to the violation of the human rights of transsexuals and transgenders. The protocols of care for transnssexual and transgender patients are maladapted and out of synch with the evolution of knowledge and of society. Transhumanism is a means of advocating a re-engineering of conditions that surround human existence at both ends. The problem set before us in this chapter is to inquire into what determined its appearance, in particular in the humanism it seeks to overcome. We look at the spirit of overcoming itself, and the impatience with the Self, in order to try to understand why it seeks a saving power in technology. We then consider how the evolutionary account of the production of (...) organisms does not set them against a perfect standard, but rather injects in them a contingency that seems to be near to the heart of the problem. We then try to assess the objective basis for improvements and manipulation of nature, and although we do not find it forbidden on all occasions, it seems that the criteria for such alterations are impossible to detach from a form of eugenics. We finally open a window toward a theological account of the problem, and find that the desire of autonomy and independence is inevitably going to be challenged by the Christian dogma of creation. In a proleptically queer mode, Avery Cardinal Dulles’s Models of the Church argued that the church—a mystery—must bear multiple simultaneously true, dynamic, indispensable, yet inadequate labels. If so, one theological test of our ethics is their ability to sustain ecclesiological multiplicity. The anti-trans* policies of some US dioceses and of the Congregation for Catholic Education (CCE) document “‘Male and Female He Created Them’” embrace Dulles’s institution model to the point of exclusive authoritarian institutionalism, while other CCE documents, embracing open-ended, (...) loving dialogue across difference, favor his communion and community of disciples models without discarding the other dimensions of church. Dulles’s belief in the dynamism and temporality of ecclesiological models is permission to replace the institution model, which is vulnerable to abuse, with a kenotic model drawn from queer theology that installs apophasis and self-criticism as indispensable elements of ecclesiology. Ethics of sexuality and gender must pass this ecclesiological test. (shrink)

In this essay, I depart from the historical exclusion of trans women’s ethical insights from care ethics by focusing on trans literature as a source of knowledge expressed by trans women about care. I open up with the systematic denial of trans women as ethical knowers by analyzing Marilyn Frye's characterization of trans women as mindless servile robots under patriarchy. I then turn to trans literature to counter this portrayal. Specifically, I discuss short stories by Casey Plett and Ryka Aoki (...) as sources of knowledge about assumptive and futurebound practices of care. I begin by arguing that the work of Maria Lugones considers the spatial dimensions of love, and that this suggests that care involves giving space to another on their own terms. I then turn to Plett’s story “Other Women” to unpack assumptive care as a short-circuited form of caring in which a relationship to the other on their own terms is closed off by transphobic assumptions. I contrast this with Plett’s story “Winning,” which describes a futurebound care in which another’s space is kept open, permitting action that allows them to flourish on their own terms. After this, I discuss Aoki’s “To the New World” as an engagement with both racist assumptive care and futurebound care aimed at self-care. I conclude that these stories provide a rich space for considering trans ethical knowledge about care. (shrink)

Gender affirming hormone treatment is an important part of the care of trans adolescents which enables them to develop the secondary sexual characteristics congruent with their identified genders. There is an increasing amount of empirical evidence showing the benefits of gender affirming hormone treatment for psychological health and social well-being in this population. However, in several countries, access to gender affirming hormone treatment for trans adolescents has recently been severely restricted. While much of the opposition to gender affirming hormone (...) treatment for trans adolescents has in part been ideologically motivated, it also reflects a debate about whether there are harms that outweigh the benefits of the treatment. Accordingly, a systematic and comprehensive philosophical analysis of the ethics of gender affirming hormone treatment for trans adolescents is needed. Herein, I offer such an analysis that draws on the four principles of biomedical ethics by Tom Beauchamp and James Childress. Based on the considerations of beneficence, nonmaleficence, autonomy, and justice, I argue that the provision of access to gender affirming hormone treatment for consenting trans adolescents is ethically required and that the current restrictions to such treatment are ethically wrong. With a focus on hormone treatments, this article contributes to recent problematizations of the ontology of bodies, illnesses and medication. Hormone treatment is conventionally understood to comprise preparations like pills, patches or injections, and following from this understanding, the materiality of risk is perceived as potential adverse effects of pharmaceuticals within individual bodies. By discussing Finnish trans persons’ experiences of hormone treatments, and drawing from material feminisms and trans/feminist studies, this article rethinks what ‘hormone treatments’ and their risks materially entail. Stressing the importance of accounting for the relationality of risks, the article suggests that hormone treatment risks can be seen as Baradian ‘phenomena’ that materialize contextually within specific ‘treatment apparatuses’ and the power relations that saturate them. This process of materialization includes the gendering of risks and how the gender binary itself may at times constitute a risk. (shrink)

In this essay Ernst Cassirer addresses two currents of the philosophical reflection about man and culture that emerged at the end of the 18th century. Th e naturalistic one, conceives of man and culture as an outcome of the processes that takes place beyond the reach of human will and consciousness. Among such naturalistically oriented philosophies Cassirer includes Hegel’s idealism, Taine’s positivism and Spengler’s psychologism. All of them imply a characteristic kind of historical fatalism. In opposition to such a (...) deterministic vision of human development stands a philosophy that emphasizes the importance of individual decision and responsibility for the course of history. Cassirer names it “humanistic” as it places man in the very middle of its research. The initiators of this tradition were Johann Gottfried Herder and Wilhelm von Humboldt, foremost representatives of the German romantic movement. The philosopher who took up their humanistic thought and elevated it to the importance of a distinct knowledge was Wilhelm Dilthey. While bearing in mind who is the real creator of culture all these thinkers pay special attention to the question of man’s responsibility for culture as well as for himself. The problem of human responsibility that totally escaped the attention of naturalistically oriented philosophers is somehow a distinguishing characteristic of all humanistic philosophies of culture. We assessed the attitudes, perceptions, and stereotypes toward Latino immigrants among 247 mental health professionals across 32 U.S. states. We also randomly presented two versions of an attitude measure that varied in their references to immigrants. Participants reported that they did not agree with the anti-immigration law Arizona SB 1070 and other similar bills. Also, greater multicultural awareness was related to positive attitudes and fewer stereotypes toward immigrants. Furthermore, participants who were asked to think about “undocumented immigrants” viewed Latino immigrants (...) more positively than those who were asked think about “illegal aliens.” Findings show the continued need for multicultural awareness and competence training for mental health professionals, which align with the American Psychological Association’s Ethical Principles of Psychologists and Code of Conduct. In this article, I argue that scholarship on the cultural impact of neoliberalism provides a vital framework with which to revisit early trans critiques of Butlerian queer feminism. Drawing on this scholarship, I reread the appeals to the real and realness in these critiques through the neoliberal transformation of social difference. I link the early argument that some trans figures were problematically used in queer feminism to represent the fluidity of identity with the more recent argument that the flexibility of (...) identity has become a core part of neoliberal cultures. This context challenges the current dominant view of early trans critiques of Butler as misreadings and instead casts them as resistant to a superficial encouragement of individual flexibility. As a result, revisiting this debate demonstrates the need to rework theoretical frameworks that may continue to inadvertently lead to selective trans inclusion in queer feminism and points the way to trans-queer-feminist theory that is more attuned to shifting models of power. This paper examines the challenges to critical realism posed by the ways in which the original postmodern sensibility has transformed into various forms of anti-humanism, trans-humanism, and post-humanism. These transformations, largely growing out of poststructuralism, are reinforced by developments in psychology and computer science but also incorporate a new turn toward ontology in alternate forms of realism such as Object-Oriented-Ontology. This paper identifies what is new and what is old in these trends and argues that, while there is something to (...) be learned from them, some of which implicitly and even explicitly borrow from CR, the humanist orientation of CR continues to deserve defense. In this article, the authors take up the historical figure of Dr Betty Paërl, who has surprisingly turned up in very different kinds of specialised archives. The white mathematics professor was located in IHLIA LGBT+ Heritage, the largest queer heritage collection in Europe, as a notable SM sexpert and spokesperson on transgender politics, and also found during archival research into the anti-(neo)colonial struggles of Suriname against the Dutch. Upon closer inspection of the materials, the authors find the recurrent image/item of (...) the whip that presses them to carefully think through how the archive of Dr Paërl casts light on a history that Katherine McKittrick calls being ‘in the shadow of the whip’. The article aims to combine an analysis of these versions of the whip in different visual and discursive registers to detect the liberatory politics underlying her activisms. To do so, the authors develop the intersectional model of the kaleidoscope employed by Dutch Black, migrant and refugee (BMR) feminist theorists to grasp the shifting patterns of power that Paërl battled and embodied as an activist of the anticolonial struggle, for sex workers’ rights, for kinky sex and for transgender people. This is all the more important in the historical study of transgender visual materials that most often arrive in archives via medical and police photography or pornographic materials. The historical researcher, the article argues, should be wary of (re)producing a static vision that would reduce transgender figures to sex and gender politics, or eclipse a vision of trans politics that dilates beyond sexuality.
